Terms  &  conditions

We are S-Kape Travel Agency, located in Atlanta, Georgia USA. The following terms & conditions (the "Agreement") describe what you can expect from us. The terms "we", "us", and "our" refer to S-Kape Travel Agency and the term "you" refers to the individual who signs this agreement.

 

S-Kape Travel Agency is acts as a "Booking Agent" for products and services that are not directly supplied by us; air and/or ground transportation, hotel accommodations, tours, cruises, etc. We sell a variety of travel related products from different suppliers, vendors and service providers. Each supplier/vendor has their own terms and conditions that are applicable to your particular arrangements in addition to our general terms and conditions. As we are not a co-vendor of such products and services, you will be entering into a separate contract with such suppliers/vendors in connection with such products and services. It is your responsibility to review and understand these terms and conditions.

DEPOSITS & PAYMENTS
S-Kape Travel Agency provides travel quotes and only accepts USD as a form of payment. Initial deposits or full payment is due at the time of booking to confirm the proposed components of your itinerary. Unless otherwise stated, all deposits are non-refundable. You will be advised of the final payment due date when placing your initial deposit to confirm your reservation. Upon provision of your payment information, you are authorizing S-Kape Travel Agency to make payment arrangements on your behalf with the corresponding suppliers/vendors. We reserve the right to refuse personal checks and/or cash as a method of payment. 

 

Payments are only processed during normal business hours. Payments received after hours may not be processed until the next business day.

LATE PAYMENT
If there is any outstanding balance by the final payment due date listed on your invoice, your trip may be cancelled or a late fee may be added to your invoice. Cancellations policies are set by suppliers and cannot be modified. You will be held responsible for any cancellation penalties or fees. Cancellation and late fees will vary. Please contact us immediately, and in advance of your final payment due date, if you will be unable to meet this obligation. Without limitation, traveler(s) shall not hold S-Kape Travel Agency liable for cancellation of any booking for either late payment or declination of a credit card.

 

CHARGEBACKS

In the event of a dispute or chargeback initiated by you without prior communication with S-Kape Travel Agency or applicable suppliers, you understand and agree that we may be required to provide evidence to the payment processor or financial institution to support the validity of the transaction. If you encounter any issues, discrepancies, or concerns related to your booking, we strongly encourage you to contact us promptly at 770-355-0649 or inquire@s-kapetravelagency.com. We are committed to resolving any problems efficiently and to your satisfaction.

 

Initiating a chargeback without valid reason or prior communication S-Kape Travel Agency or applicable suppliers is considered a breach of this agreement. In such cases, we reserve the right to pursue legal action to recover any incurred costs, including but not limited to legal fees and associated expenses.


ADDITIONAL FEES

S-Kape Travel Agency reserves the right to charge booking change fees, cancel fees, or any other applicable fees in addition to the supplier. All fees charged by S-Kape Travel Agency are non-refundable.

PRICING

Prices and availability quoted by S-Kape Travel Agency are not guaranteed until your deposit is fully processed. Prices are correct at time of publication; however, as airfares continually fluctuate and classes of service may have limited capacity, travel package prices and availability may change without notice. In case of human or computer error, S-Kape Travel Agency reserves the right to re-invoice for the correct price or service.

Suppliers reserve the right not to honor any published prices that it determines were erroneous due to electronic, printing, or clerical error. You acknowledge this is right and agree not to hold S-Kape Travel Agency liable for any actions or damages arising from supplier pricing. S-Kape Travel Agency reserves the right to charge passenger(s) for any increase in taxes, fees or surcharges (i.e. fuel). Passenger(s) acknowledge this right and agree to pay any such additional taxes, fees, and surcharge.

IDENTIFICATION
All travelers are required to make reservations under their full name stated on his/her government document they will use for travel. If you need to make any changes to a name after travel documents have been issued, you will be responsible for any name change fees, if applicable. These fees are set by the airline, hotel, vendor and/or supplier. S-Kape Travel Agency shall not be held liable if you, the traveler, provides incorrect spelling or delay notifying of us of any legally changed names. It is the travelers responsibility to review all final travel documents, notifying S-Kape Travel Agency of any errors. While we will make every possible attempt to make such a change if necessary, please bear in mind that most airlines and suppliers treat a name change as a cancellation, to which standard conditions and charges would apply.

PASSPORT/VISA REQUIREMENTS
Many countries require passports to be valid for 6 months beyond the date of travel. Please check that all passports are valid. Some countries require a full blank “VISA” page in the passport for stamping purposes. 

 

S-Kape Travel Agency can assist in advising entry requirements, but it is the sole responsibility of the traveler to ensure that passports, travel documents and entry visas meet the conditions of the destination(s) the traveler is visiting. Any information provided on the travel description pertains to U.S. citizens only. Non-U.S. citizens should check with the respective consulate of the destination(s) to be visited for current entry requirements. We do not accept any responsibility in the case of you being unable to travel due to not complying with such requirements.

TRAVEL ADVISORIES/VACCINE REQUIRMENTS
U.S. citizens should refer to the travel advice posted by the U.S. Department of State at travel.state.gov for all destinations you intend to visit. Vaccinations may be required for some or all of the destinations you are intending to visit. It is your responsibility to ensure that you have arranged all necessary vaccinations for your itinerary. S-Kape Travel Agency does not accept any responsibility in the case of you being denied travel or entry due to not complying with such requirements.

COVID-19 WAIVER

An inherent risk of exposure to COVID-19 exists in any public place where people are present. COVID-19 is an extremely contagious disease that can lead to severe illness and death. According to the Centers for Disease Control and Prevention, senior citizens and Guests with underlying medical conditions are especially vulnerable. By visiting any international destination you voluntarily assume all risks related to exposure to COVID-19.

TRAVEL INSURANCE
All passengers are strongly recommended to take out adequate travel insurance to protect themselves against cancellation for any reason prior to or during travel. In the event of a traveler becoming ill during a tour, all hospital and medical expenses are the traveler’s responsibility and they shall not be entitled to any refund, either total or partial, of any money paid. In addition to that, if a traveler has to cancel for any reason during a tour, all expenses are the traveler’s responsibility and they shall not be entitled to any refund, either total or partial, of any money paid. The passenger may incur up to 100% cancellation penalties and should protect themselves with travel insurance. If purchased, travel insurance is to be paid in full at time of booking, and in addition to your deposit. Travel insurance is non-refundable after being added to your reservation.

By declining travel insurance, you acknowledge and accept liability for any cancellation penalties, damages and/or out–of-pocket expenses incurred.  You also acknowledge and accept responsibility for arranging and paying for any treatment in case of a medical emergency while traveling. Please note that if you decline this type of coverage, you have waived your right to this important coverage and your confirmation will note “declined” next to the travel insurance section of your confirmation. If you have purchased travel insurance, please remember to review your confirmation for accuracy and call us immediately if you believe you have travel insurance and your confirmation indicates declined. Failure to contact us will be considered waiver of travel insurance.

PHOTOGRAPHIC RELEASE
S-Kape Travel Agency may take photographs or videos of its trip participants during a trip hosted directly by the agency. Each traveler who travels with the agency hosted group has granted permission to be photographed for use of any promotional or commercial use without payment of any compensation to participants/travelers. Any traveler/persons who utilizes the hashtags #SkapeTravelAgency, #SkapeTravelClub on any social media platform consents to be reposted, shared or utilized for any promotional or commercial use without any form of compensation.

PRIVACY
While using any service offered by S-Kape Travel Agency, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you (“Personal Information.”). Personally identifiable information may include, but is not limited to your name, address, phone number and email address.

​

When you provide us with personal information to complete a transaction, authorize payment, verify your credit card, place an order, arrange for a delivery or return a purchase, we imply that you consent to our collecting it and using it for that specific reason only. Your information will never be shared with any third party. If we ask for your personal information for a secondary reason, like marketing, we will either ask you directly for your expressed consent, or provide you with an opportunity to say no.

FORCE MAJEURE
S-Kape Travel Agency shall not be liable for any claims, losses, damages, costs, expenses, delays or loss of enjoyment, of any nature or kind whatsoever, resulting from events beyond our or a supplier’s reasonable control, including but not limited to acts of God, strikes, lockouts or other labor disputes or disruptions, protests, wars, blockades, insurrections, riots, earthquakes, weather conditions, floods or acts or restraints imposed by government authorities.

RELEASE OF LIABILITY
S-Kape Travel Agency and/or its agents act only as agents for the client in all matters pertaining to travel. They assume no responsibility nor liability in connection with the service of any train, vessel, carriage, aircraft, motor or other conveyances which may be used, either wholly or in part, in the performance of its duty to the passenger; neither will it be responsible for any act, error, or omission, or any injury, loss, accident, delay or irregularity which may be occasioned by reason of any defect in any vehicle or through the neglect or default of any company or person engaged in carrying out the purpose for which tickets or coupons are issued.

 

In the event that it becomes necessary or advisable for the comfort or well-being of the passengers, or for any reason whatsoever, to alter the itinerary or arrangements, such alterations may be made without penalty to the operators. Additional expenses, if any, shall be borne by the passengers, conversely refunds will be made to the passengers if any saving is effected thereby. The airlines concerned are not to be held responsible for any act, omission, or event, during the time passengers are not on board their planes or conveyance. The passage contract in use by the airlines concerned, when issued, shall constitute the sole contract between the airlines and the purchaser of these tours and/or passenger. The right is reserved to withdraw any or all tours should conditions warrant, also to decline to accept or retain any passengers as members of the tours. S-Kape Travel Agency can assume no responsibility for lost tickets or coupons.

VOLUNTARY ACCEPTANCE OF THESE TERMS AND CONDITIONS 

S-Kape Travel Agency is an independent contractor and no joint venture, partnership or employment relationship exists between you and us or our suppliers as a result of this agreement. We reserve the right at any time to modify or cancel this agreement without prior notice to you.

I agree and understand that S-Kape Travel Agency and/or their agents can accept no responsibility for losses or accidental expenses due to delays or changes in airline/rail or other means of transport schedule, hotel over-booking or default, sickness, weather, strikes, war, quarantine or other causes. 

 

I have carefully read these Terms and Conditions and the booking information sections of this document, and fully understand its contents. I am aware that this is a release of liability and a contract between myself and S-Kape Travel Agency and agree of my own free will.
